Recently, I received a letter from the Title Compliance Office in the mail telling me just how important it was that I have a copy of my Grant Deed.
The letter said: “NOTE: Due to property foreclosures and loan modifications in your county you should obtain a copy of your Grant Deed.”
“Now that’s interesting,” I thought. Foreclosures and loan modifications in the county have NOTHING to do with your need to have a Grant Deed.
The letter went on to say that I needed a “certified” copy of the Grant Deed. Certified? A Grant Deed is only meaningful (legal) if it’s recorded with the county in which the property is situated.
Finally, the letter went on to say that I could obtain said important, certified copy simply by sending a check or credit card number to the Title Compliance Office for $167.
I hope none of you have fallen victim to this scam, because that’s exactly what it is. Here’s why it’s a scam:
1. A grant deed is a recorded document. It transfers title (ownership) to a property when it is sold. Once recorded, it is a public document. That means you can get a copy of it by going down to the county recorder’s office and asking for one…for about 10 bucks.
2. Having the document in your possession is a good idea, but it’s not a life or death emergency if you don’t. There will probably never be a day when an offical comes to your door and demands to see your grant deed. You don’t even need the copy when you sell your home; the lender and title company will get a new one from the county.
3. If you know a professional Realtor (and if you are reading this…you do!) they can most likely get you a copy for FREE.
Please don’t be taken in by this scam! There are a number of “companies” sending out these notices besides the Title Compliance Office. Even if they provide you with a copy, they are just stealing your money.
